Authors, Publishers, and Google Reach Landmark Settlement
Copyright Accord Would Make Millions More Books Available Online
The Authors Guild, the Association of American Publishers (AAP), and Google today announced a groundbreaking settlement agreement on behalf of a broad class of authors and publishers worldwide that would expand online access to millions of in-copyright books and other written materials in the U.S. from the collections of a number of major U.S. libraries participating in Google Book Search. The agreement, reached after two years of negotiations, would resolve a class-action lawsuit brought by book authors and the Authors Guild, as well as a separate lawsuit filed by five large publishers as representatives of the AAP’s membership. The class action is subject to approval by the U.S. District Court for the Southern District of New York.
The agreement promises to benefit readers and researchers, and enhance the ability of authors and publishers to distribute their content in digital form, by significantly expanding online access to works through Google Book Search, an ambitious effort to make millions of books searchable via the Web. The agreement acknowledges the rights and interests of copyright owners, provides an efficient means for them to control how their intellectual property is accessed online and enables them to receive compensation for online access to their works.
If approved by the court, the agreement would provide:
- More Access to Out-of-Print Books – Generating greater exposure for millions of in-copyright works, including hard-to-find out-of-print books, by enabling readers in the U.S. to search these works and preview them online;
- Additional Ways to Purchase Copyrighted Books – Building off publishers’ and authors’ current efforts and further expanding the electronic market for copyrighted books in the U.S., by offering users the ability to purchase online access to many in-copyright books;
- Institutional Subscriptions to Millions of Books Online – Offering a means for U.S. colleges, universities and other organizations to obtain subscriptions for online access to collections from some of the world’s most renowned libraries;
- Free Access From U.S. Libraries – Providing free, full-text, online viewing of millions of out-of-print books at designated computers in U.S. public and university libraries; and
- Compensation to Authors and Publishers and Control Over Access to Their Works – Distributing payments earned from online access provided by Google and, prospectively, from similar programs that may be established by other providers, through a newly created independent, not-for-profit Book Rights Registry that will also locate rightsholders, collect and maintain accurate rightsholder information, and provide a way for rightsholders to request inclusion in or exclusion from the project.
Under the agreement, Google will make payments totaling $125 million. The money will be used to establish the Book Rights Registry, to resolve existing claims by authors and publishers and to cover legal fees. The settlement agreement resolves Authors Guild v. Google, a class-action suit filed on September 20, 2005 by the Authors Guild and certain authors, and a suit filed on October 19, 2005 by five major publisher-members of the Association of American Publishers: The McGraw-Hill Companies, Inc. (NYSE: MHP); Pearson Education, Inc. and Penguin Group (USA) Inc., both part of Pearson (LSE: PSON; NYSE: PSO); John Wiley & Sons, Inc. (NYSE: JWa and JWb); and Simon & Schuster, Inc. part of CBS Corporation (NYSE: CBS.A and CBS). These lawsuits challenged Google’s plan to digitize, search and show snippets of in-copyright books and to share digital copies with libraries without the explicit permission of the copyright owner.
Holders worldwide of U.S. copyrights can register their works with the Book Rights Registry and receive compensation from institutional subscriptions, book sales, ad revenues and other possible revenue models, as well as a cash payment if their works have already been digitized.
Libraries at the Universities of California, Michigan, Wisconsin, and Stanford have provided input into the settlement and expect to participate in the project, including by making their collections available. Along with a number of other U.S. libraries that currently work with Google, their significant efforts to preserve, maintain and provide access to books have played a critical role in achieving this agreement and, through their anticipated participation, they are furthering such efforts while making books even more accessible to students, researchers and readers in the U.S. It is expected that additional libraries in the U.S. will participate in this project in the future.
Google Book Search users in the United States will be able to enjoy and purchase the products and services offered under the project. Outside the United States, the users’ experience with Google Book Search will be unchanged, unless the offering of such products and services is authorized by the rightsholder of a book.

Qik Launches First Live Mobile Video Streaming on Mass Market Phones
Support for phones from Nokia and Sony Ericsson brings inaugural live streaming to J2ME handsets, the most ubiquitous application platform for mobile devices

Did you know that millions of bloggers around the world write new posts each week? If you’re like me, you probably read only a tiny fraction of these in Google Reader. What’s everybody else writing about? Our Blog Search team thought this was an interesting enough question to look into. What we found was a massive mix: entertaining items about celebrities, personal perspectives on political figures, cutting-edge (and sometimes unverified) news stories, and a range of niche topics often ignored by the mainstream media.
Today, we’re pleased to launch a new homepage for Google Blog Search so that you too can browse and discover the most interesting stories in the blogosphere. Adapting some of the technology pioneered by Google News, we’re now showing categories on the left side of the website and organizing the blog posts within those categories into clusters, which are groupings of posts about the same story or event. Grouping them in clusters lets you see the best posts on a story or get a variety of perspectives. When you look within a cluster, you’ll find a collection of the most interesting and recent posts on the topic, along with a timeline graph that shows you how the story is gaining momentum in the blogosphere.

New Cancer Data Shows Women Do Not Feel Knowledgeable About Their Cancer Risks and Justifies Need for More Credible Health Information; Show Set to Educate and Entertain
Olympic champions of the 2008 Summer Games, led by Shawn Johnson and Nastia Liukin, along with Team USA will join with some of the biggest names in music for a national network television special, Frosted Pink with a Twist, in an effort to inspire action, celebrate survivorship and encourage women to become advocates for themselves in the fight against cancer.
Paired with these gymnasts will be icons of song, including Grammy-award winner Carole King, Cyndi Lauper and billboard sensations, Natasha Bedingfield and Jesse McCartney, making for a historical event of sports, entertainment, and health awareness. Also appearing will be hip-hop singer and Dancing with the Stars contestant Mario and Kenny Loggins. Cancer survivor Sharon Osbourne will be accepting the Nationwide® Insurance Woman of Courage award.
Frosted Pink with a Twist is the anchor event of a multi-year television and multimedia campaign that focuses on educating viewers about cancers that primarily affect women. Co-hosted this year by Olympic Gymnastics Champion Shannon Miller and cancer survivor and Olympic Figure Skating Champion Scott Hamilton, the show will highlight current Olympic champions Shawn Johnson, Nastia Liukin, Paul Hamm, Shannon Miller, and other stars of the men’s and women’s US Olympic Gymnastics teams.
“Frosted Pink’s message is simple, but necessary: we all need to do our part in the fight against women’s cancer,” said Ms. Miller. “Our hope is that with more information, women will become empowered and become better advocates for their own health.”
Raising awareness is especially significant because research continues to find that despite significant improvements in the diagnostic tools and treatment options for women’s cancers, many women lack the basic information they need to help protect them from a cancer diagnosis. In fact, a recent Woman’s Day magazine survey of nearly 7,000 women found that only 21 percent of respondents believe that they are very knowledgeable about the risk factors associated with cancer even though an overwhelming 90 percent agree that cancer is our nation’s biggest healthcare fear. The majority (51 percent) wished they knew where to find credible and reliable information about cancer, justifying the need for more educational efforts like Frosted Pink with a Twist.
Woman’s Day, the official media partner of Frosted Pink with a Twist, surveyed 6,534 women on womansday.com to gauge their perspectives, hopes and fears of cancers that primarily affect women. While 76 percent of the respondents disagree or were unsure that cancer is a death sentence, the vast majority (63%) do not believe that they will see a cure for cancer in their lifetime. And strikingly, even though the American Cancer Society estimates that 1 in 3 women will develop cancer at some point in their lifetime, the majority of respondents (51%) were either unsure or felt it was unlikely that they would get cancer in their lifetime.
“According to the National Cancer Institute (NCI), an estimated 260,950 women will be diagnosed in 2008 with a women’s cancer in the United States,” said co-host Scott Hamilton. “And as a cancer survivor, I understand the need to do a better job providing people with the tools they need to become their own health advocates. We need to take every opportunity to educate as we entertain.”

BRUCE SPRINGSTEEN AND THE E STREET BAND will perform in the BRIDGESTONE SUPER BOWL XLIII HALFTIME SHOW on NBC at Raymond James Stadium in Tampa on Sunday, February 1, the NFL and NBC announced tonight.
The Super Bowl halftime show is annually the most-watched musical performance. More than 148 million viewers in the U.S. watched last year’s show. The Super Bowl and halftime show will be broadcast worldwide in more than 230 countries and territories.
Bruce Springsteen and the E Street Band join an esteemed list of recent halftime acts that includes the Rolling Stones, U2, Paul McCartney, Prince and Tom Petty and the Heartbreakers.
The BRIDGESTONE SUPER BOWL XLIII HALFTIME SHOW is an NFL NETWORK PRODUCTION and will be executive produced by Ricky Kirshner and Glenn Weiss of WHITE CHERRY ENTERTAINMENT and by DON MISCHER PRODUCTIONS. Don Mischer also will serve as director.

Jive/Zomba recording artist Britney Spears announces her sixth studio album, Circus, set for release December 2nd. The first single from the album is titled “Womanizer” and was produced by the up-and-coming Atlanta production team The Outsyders. The album release date coincides with Spears’ birthday.
On the heels of an MTV VMA awards sweep, where Britney walked away with three Moonmen awards for “Video of the Year,” “Best Female” and “Best Pop Video” for “Piece of Me,” Jive Records is preparing her latest album, Circus, a follow-up to her critically well received album, Blackout. Family of former FDNY firefighter battling Multiple Myeloma makes urgent plea for public help
Firefighter Roy Chelsen battled bravely for us on September 11, 2001 — but now he is gravely ill and desperately needs our help. Chelsen, then a member of the FDNY Engine Company #28 on September 11, 2001 — was among the first firefighters to respond to the terror attacks at The World Trade Center, and helped save many lives. But for the last three years, Roy Chelsen has been battling multiple myeloma, an aggressive bone marrow cancer. He has undergone chemotherapy treatments, surgery and numerous transfusion therapies. Now after one year in remission, Chelsen needs a bone marrow transplant from a matching donor to save his own life. Born in Brooklyn, Roy Chelsen and his immediate family lived in Staten Island before settling in Warwick, Orange County, NY. He is 48 year old and married, with one son.
We are asking that everyone — from friends, residents, blood donors, and members of the FDNY, NYPD and the Port Authority to please step out and give blood in support of retired firefighter Roy Chelsen. Bone marrow cancer patients require blood transfusions because treatment kills both cancer cells and healthy, blood-forming cells. Each donated pint of blood can save as many as three lives. All donors receive free mini-medical exams on site and information about their temperature, pulse rate, blood pressure and hemoglobin level. Eligible donors include those people at least age 16 with parental consent (in NY) or 17 (in NJ), who weigh a minimum of 110 pounds, are in good health and meet all Food & Drug Administration and NY or NJ State Department of Health donor criteria. Inquiries are also welcomed from organizations who would like to schedule a blood drive.
